Rationes Decidendi:

If agreed in the arbitration agreement that an arbitration centre is to render organisational (administrative) services in connection with the arbitration proceedings (in the capacity of what is known as case administrator), then this centre is not authorised to decide on issues pertaining to the merits of the dispute, nor on objections filed by the parties, once the arbitral tribunal is constituted. In accordance with the competence-competence principle, decisions on these matters are in the sole competency of the arbitral tribunal.
